Version 2.0. This version applies from 15 September 2026.

1. EVA’Z and definitions

1.1.

These Terms & Conditions are used by EVA’Z Yoga & Pilates, located at Blekersvaartweg 19B, 2101 CB Heemstede, registered with the Dutch Chamber of Commerce under number 51959267, hereinafter referred to as: EVA’Z.

1.2.
EVA’Z can be contacted via:
email: info@evaz.nl;
telephone: 06-24201111;
website: www.evaz.nl.
1.3.
In these Terms & Conditions, the following definitions apply:
Customer the person who purchases or books a class, pass, workshop, special or other service from EVA’Z.
Participant the person who actually takes part in a class, workshop or other activity. The Customer and Participant may be the same person.
Eversports the external online platform used by EVA’Z for, among other things, the schedule, bookings, purchases, payments and management of class credit.
Regular class a Pilates or yoga class that forms part of EVA’Z’s regular class schedule. Workshops and specials are not included.
Multi-class pass personal class credit that entitles the holder to attend a specified number of regular classes within the validity period stated at the time of purchase.
Time-based pass a pass that allows the holder to attend a maximum of one regular class per day during a specified period.
Workshop or special an activity outside the regular class schedule for which a separate price, validity period or additional conditions may apply.

2. Applicability and agreement

2.1.

These Terms & Conditions apply to all agreements between EVA’Z and a Customer and to participation in classes, workshops, specials and other EVA’Z activities.

2.2.

Before or at the time the agreement is concluded, the Customer is given the opportunity to read and save these Terms & Conditions.

2.3.

When a purchase or booking is made through Eversports, the agreement for the relevant class, pass, workshop, special or other service is concluded directly between the Customer and EVA’Z. Eversports facilitates the booking and payment.

2.4.

If additional or different conditions are stated before purchase for a specific product, workshop or special, those specific conditions apply to that product. These Terms & Conditions remain applicable in all other respects.

3. Offer, prices and payment

3.1.

The current offer, prices, number of classes and validity periods of passes are made available before purchase through EVA’Z and/or Eversports.

3.2.

The price shown at the time of purchase is the price applicable to that agreement. Later price changes do not affect agreements that have already been concluded.

3.3.

Payment is made in advance unless EVA’Z expressly agrees otherwise.

3.4.

An agreement for the purchase of a class pass, single class, trial class, workshop, special or other product is concluded once the purchase has been electronically confirmed through Eversports. A booking for a specific class is concluded once it has been confirmed through Eversports. If a booking is made using previously purchased class credit, that booking forms part of the performance of the previously concluded agreement.

3.5.

Class passes and other EVA’Z products are not renewed automatically. Once a pass has expired or been used, the Customer decides whether to purchase a new pass.

4. Trial class, introductory month, multi-class passes and time-based passes

4.1.

A trial class entitles the Customer to attend one suitable regular class. The classes that may be attended as a trial class are stated before purchase through the website and/or Eversports.

4.2.

For the introductory month, the number of classes, validity period and permitted use are those stated at the time of purchase through the website and/or Eversports.

4.3.

For multi-class passes, the number of classes and validity period stated at the time of purchase in Eversports apply.

4.4.

Unused classes expire when the validity period of the relevant multi-class pass ends, unless EVA’Z has granted an extension or temporary suspension in writing or the law provides otherwise.

4.5.

A time-based pass starts on the date of the first class booked using that pass.

4.6.

A time-based pass allows the Customer to attend a maximum of one regular class per day during the validity period. All regular classes in the schedule may be combined, subject to availability.

4.7.

Workshops, specials and other activities outside the regular schedule are not automatically included in a multi-class pass or time-based pass.

4.8.

Passes and class credits are personal and non-transferable unless EVA’Z expressly allows otherwise in advance.

4.9.

When a 7-day pass or 4-week pass is purchased, an existing valid multi-class pass can be temporarily paused upon request. This option does not apply to other time-based passes unless EVA’Z expressly agrees otherwise.

5. Booking and waitlist

5.1.

Participation in a class is only possible when a valid booking has been made through Eversports.

5.2.

A booking is final once it has been confirmed in the Customer’s Eversports account.

5.3.

If a class is full, the Customer can join the waitlist through Eversports.

5.4.

A place that becomes available is not automatically assigned to someone on the waitlist. When Eversports notifies the Customer that a place is available, the Customer must book it themselves. The first person to book the available place gets it.

5.5.

The Customer is responsible for their own settings for receiving Eversports notifications.

6. Cancellation, late arrival and no-show

6.1.

A booking for a regular class can be cancelled free of charge through Eversports up to 24 hours before the class starts.

6.2.

For a single class, trial class, introductory month or multi-class pass, the class credit used for the booking is forfeited if the booking is cancelled within 24 hours before the class or if the Participant does not attend.

6.3.

With a time-based pass, no individual class credit can be forfeited. If a booking is cancelled within 24 hours before the class or if the Participant does not attend, a €12.50 cancellation fee is therefore payable. EVA’Z will send a separate payment request. The amount due must be paid within 7 days of receiving the payment request.

6.4.

If someone arrives after the class has started and can no longer take part as a result, this is treated as a no-show for the purposes of this article.

6.5.

If timely cancellation through Eversports is impossible as a direct result of a demonstrable technical failure, the booking will be treated as having been cancelled on time, provided that the Customer can reasonably demonstrate that they attempted to cancel before the deadline referred to in article 6.1 and informs EVA’Z as soon as possible, but no later than before the start of the class.

6.6.

Different cancellation conditions may apply to workshops and specials. These will be communicated before purchase.

7. Validity, suspension and special circumstances

7.1.

A pass can only be used within the validity period stated at the time of purchase.

7.2.

Unused classes or remaining class credit are not paid out in cash after the validity period ends unless the law provides otherwise.

7.3.

In the event of long-term illness, injury, recovery or another special personal circumstance, the Customer may ask EVA’Z to temporarily pause a pass or extend its validity.

7.4.

EVA’Z assesses such requests individually and reasonably. EVA’Z may ask for appropriate supporting information but will not request more personal or medical information than is reasonably necessary to assess the request.

7.5.

Holidays, work, personal scheduling or failure to book classes in time do not automatically entitle the Customer to an extension of a pass.

8. Class schedule, teachers and cancellation by EVA’Z

8.1.

EVA’Z makes the class schedule available through Eversports and may change the schedule, teacher or content of a class when reasonably necessary.

8.2.

A change of teacher or a limited change to the content of a class that does not materially alter the time or character of the class does not entitle the Customer to a refund and does not affect the normal cancellation conditions.

8.3.

If EVA’Z changes the date, time or character of a booked class to such an extent that the Customer cannot reasonably be expected to attend the changed class, the Customer may cancel the booking free of charge. Any class credit used will not be deducted or will be restored, and no cancellation fee will be charged to a Customer using a time-based pass.

8.4.

If EVA’Z cancels a booked regular class, any class credit used will not be deducted or will be restored, and no cancellation fee will be charged to a Customer using a time-based pass.

8.5.

If a schedule change or temporary closure by EVA’Z materially limits the use of a pass for a relevant period, EVA’Z will offer a reasonable solution, for example by extending the validity period, offering a replacement option or, where required by law, providing a refund.

8.6.

The Customer is not entitled to a class taught by a specific teacher.

9. Workshops and specials

9.1.

Workshops and specials may have their own price, date, duration, capacity and cancellation conditions.

9.2.

This information will be made available before purchase through EVA’Z and/or Eversports.

9.3.

If EVA’Z cancels a workshop or special and no suitable replacement date is agreed, the amount paid for that activity will be refunded.

10. Participation and personal responsibility

10.1.

The Participant is responsible for assessing whether participation in a class or other EVA’Z activity is appropriate within their own abilities.

10.2.

Before taking part, the Participant must disclose relevant physical considerations that can reasonably be expected to be important for safe and responsible guidance.

10.3.

During classes and other activities, the Participant must follow reasonable safety and teaching instructions given by the teacher.

10.4.

EVA’Z may refuse, restrict or end participation in a class or other activity where, in its reasonable judgement, this is necessary for safe and responsible participation.

11. House rules and conduct

11.1.

Participants must behave respectfully towards teachers, other participants and other people present and must follow the reasonable house rules that apply within EVA’Z.

11.2.

EVA’Z may refuse, restrict or end participation in a class or other activity if a Participant seriously or repeatedly disrupts safety, order or the normal course of a class or activity or seriously or repeatedly breaches reasonable house rules.

11.3.

If refusal or termination of participation results from behaviour attributable to the Participant, there is in principle no right to a refund or restoration of the class credit used for the relevant class or activity, insofar as this is reasonable and legally permitted.

12. Minors

12.1.

Minors may take part in suitable classes where this fits within EVA’Z’s offer.

12.2.

Where required by law, an agreement for a minor is concluded with the consent of, or by, a parent or legal representative.

13. Liability

13.1.

EVA’Z carries out its classes and other activities with due care and observes the standard of care that may reasonably be expected from a professional provider of Pilates and yoga classes.

13.2.

EVA’Z is liable for damage insofar as that damage can be attributed to EVA’Z under applicable law.

13.3.

If damage is partly the result of a circumstance attributable to the Participant, the amount of any obligation to pay compensation may be reduced in accordance with the applicable legal rules.

13.4.

EVA’Z does not take custody of Participants’ personal belongings. Any liability for loss, theft or damage to personal belongings will be assessed in accordance with the applicable legal rules.

13.5.

Nothing in these Terms & Conditions limits or excludes statutory consumer rights or claims insofar as these cannot be limited or excluded under mandatory law.

14. Personal data

14.1.

EVA’Z processes personal data in accordance with applicable privacy legislation. EVA’Z’s Privacy Policy explains which personal data is processed, for which purposes, with which parties data is shared and which rights data subjects have.

15. Right of withdrawal for online purchases

15.1.

When a consumer enters into a distance contract with EVA’Z, the statutory 14-day right of withdrawal applies insofar as this right applies under the law.

15.2.

The withdrawal period starts on the day the agreement is concluded.

15.3.

The right of withdrawal does not apply to an agreement relating to a leisure activity where a specific date or period has been agreed for performance. This includes, among other things, a booking for a class, workshop or special on a specific date and time, insofar as the statutory exception applies.

15.4.

For the online purchase of a pass or other product for which no specific performance date or period has yet been set, the statutory right of withdrawal may apply.

15.5.

If the Customer expressly requests that the service begin during the withdrawal period and subsequently validly exercises the right of withdrawal, the Customer must pay a proportionate amount for the part of the service already provided up to the moment of withdrawal, insofar as the statutory requirements for this have been met.

15.6.

If a service has been fully performed during the withdrawal period after the Customer expressly agreed that performance could begin and acknowledged that the right of withdrawal would cease after full performance, the right of withdrawal no longer applies after full performance, insofar as permitted by law.

15.7.

The way in which a consumer can exercise an applicable right of withdrawal and the legally required information relating to that right will be made available before the agreement is concluded.

16. Changes to these Terms & Conditions

16.1.

EVA’Z may amend these Terms & Conditions from time to time.

16.2.

A new version will in principle apply to agreements concluded after the new version has taken effect.

16.3.

For an agreement that is already in progress, changes apply only insofar as this is legally permitted and reasonable. A change that materially disadvantages a Customer will not be applied to an existing agreement without a valid reason.

16.4.

The current version and effective date are available through www.evaz.nl and can be saved.

17. Complaints

17.1.

A complaint can be submitted via info@evaz.nl or directly to EVA’Z.

17.2.

EVA’Z aims to respond substantively to a complaint as soon as possible and, in principle, within 14 days. If more time is needed, the Customer will be informed.

17.3.

The parties will first attempt to resolve a dispute through mutual consultation.

18. Applicable law and disputes

18.1.

Agreements with EVA’Z and these Terms & Conditions are governed by Dutch law.

18.2.

A dispute may be submitted to the court that has jurisdiction under the law.

18.3.

Mandatory consumer rights always remain applicable.

19. Final provision

19.1.

If any provision of these Terms & Conditions is found to be wholly or partly invalid or unenforceable, the remaining provisions remain in force.

19.2.

In that case, EVA’Z and the Customer will proceed on the basis of a valid and reasonable arrangement that corresponds as closely as possible to the purpose of the original provision.
